PRIVACY POLICY

This Privacy Policy explains how Seen Live (we, us, our) collects, uses, and protects your personal data when you visit seenlivemusic.com or join our waitlist.

1. Who we are (Data Controller)

Seen Live is currently operated by Charles Blethon, a natural person based in France, acting as data controller under the EU General Data Protection Regulation (GDPR).

A French simplified joint-stock company (SAS) is currently in formation and will succeed to the data controller role. Users will be notified of this transition through this page and, where applicable, by email.

2. What data we collect

When you join our waitlist, we collect:

• Email address (required) — for service communication and waitlist access

• Artist name (required) — to identify you within the beta program

• First name and last name (optional) — for personalization of communication

• Instagram handle (optional) — scene context and community building

We also automatically record: cohort assignment (which beta wave you belong to), source (how you reached the form), and timestamp (when you joined).

If you are selected for the closed beta and choose to submit a track for analysis, we additionally collect track metadata (title, artist, streaming or download link) and promotion start date (self-declared).

We do not collect payment information, browsing history beyond our own site, or any biometric, health, or special-category data.

3. How we use your data (purposes and legal bases)

We process your data for the following purposes, each grounded in a GDPR legal basis:

• Managing your waitlist registration and cohort assignment — Performance of a pre-contract (GDPR Art. 6(1)(b))

• Sending product updates, build logs, and beta invitations — Consent (Art. 6(1)(a)), implicit by joining the waitlist, withdrawable at any time

• Running audio fingerprinting and content detection on tracks you voluntarily submit — Performance of a pre-contract (Art. 6(1)(b))

• Maintaining security, preventing fraud and abuse — Legitimate interest (Art. 6(1)(f))

• Measuring aggregate site traffic through cookieless analytics — Legitimate interest (Art. 6(1)(f))

We do not use your data for targeted advertising. We do not sell your data to third parties.

4. Who we share data with (processors and partners)

We rely on the following third-party processors to operate the service. Each has been selected for their compliance with GDPR or equivalent safeguards. Transfers outside the European Economic Area are covered by Standard Contractual Clauses (SCC) or an equivalent adequacy mechanism.

• Loops (United States) — email delivery and waitlist audience management. Receives: email, name, artist name, Instagram, cohort.

• Airtable (United States) — internal CRM for artist relationships. Receives: all waitlist data and beta activity.

• Google Workspace (United States / Europe) — email infrastructure for @seenlivemusic.com addresses. Receives: direct email exchanges with you.

• Framer (Netherlands, hosted via Vercel) — website hosting and cookieless analytics. Receives: IP-derived visit data, anonymized at source.

• Tally (European Union) — track submission form for beta participants. Receives: track metadata, submission timestamp.

• Zapier (United States) — workflow automation between internal tools, used selectively as a fallback. Receives: only data necessary for specific automation flows, if and when enabled.

• Specialized audio fingerprinting partner(s) — audio fingerprinting and content analysis on submitted tracks. Partner selection in progress; to be announced. Will receive: track metadata only, no personal identifiers beyond artist name.

Third-party audio analysis partners, once selected, will act as data processors on our behalf. They will not share, resell, or use your data for purposes other than the analysis we request. This Privacy Policy will be updated to name the specific partner(s) once contracts are finalized.

5. Cookies and tracking

Our website uses cookieless analytics provided by Framer. This means no cookies are stored on your device, no persistent identifier is placed in your browser, visit data is aggregated and anonymized at source, and no consent banner is required under GDPR/ePrivacy for this method.

We do not use Google Analytics, Meta Pixel, advertising trackers, or any third-party cookies. If this changes in the future, we will update this policy and request your consent where legally required.

6. How long we keep your data

We retain your personal data for as long as your waitlist entry is active or until you request its deletion, whichever comes first.

If you unsubscribe from our communications without requesting deletion, we keep a minimal record (email and unsubscribe timestamp) to honor your unsubscribe request.

7. Where your data lives

Your data is stored primarily in the European Union (Framer hosting, Tally).

Some processors listed above are based in the United States. Where this applies, transfers are covered by Standard Contractual Clauses (SCC) adopted by the European Commission or, where applicable, the EU-US Data Privacy Framework adequacy decision.

8. Your rights under GDPR

You have the following rights regarding your personal data:

• Right of access — obtain a copy of the data we hold about you

• Right to rectification — correct inaccurate or incomplete data

• Right to erasure (the right to be forgotten) — request deletion of your data

• Right to restriction — ask us to pause processing in specific circumstances

• Right to data portability — receive your data in a machine-readable format

• Right to object — oppose processing based on legitimate interest

• Right to withdraw consent — at any time, without affecting past processing

To exercise any of these rights, email us at privacy@seenlivemusic.com. We will respond within one month, as required by GDPR.

You also have the right to lodge a complaint with the French data protection authority, the CNIL (www.cnil.fr), or any other EEA supervisory authority.

9. Security

We apply reasonable technical and organizational measures to protect your data against unauthorized access, loss, or alteration. These include:

• Encrypted transmission (HTTPS / TLS) across the entire site and email infrastructure

• Authentication and access controls on internal tools (Airtable, Loops, Google Workspace)

• Domain-level authentication (SPF, DKIM, DMARC) to prevent email spoofing

• Ongoing review of processor security practices

No system is fully immune. If a data breach affects you, we will notify you without undue delay, as required by GDPR Art. 33–34.

10. Children

Seen Live is intended for professional artists and music industry actors. We do not knowingly collect data from anyone under 16. If you believe a minor has submitted data, contact us and we will delete the record.

11. Changes to this policy

We may update this policy as the service evolves (new processors, new features, legal changes). Material changes will be announced by email to registered waitlist members at least 15 days before taking effect.
